SECTION 35
DURATION

This Agreement shall cancel all Agreements, Supplemental Agreements, Amendments, Letters of Understanding and similar related documents executed between the Union and the Company prior to the signing of this Agreement with the exception of the following Letters of Agreement and Understanding.

This Agreement shall become effective January 7, 2005 and shall continue in full force and effect without modification until January 7, 2010, at which date this Agreement shall renew itself in its entirety and annually on each succeeding January 7th thereafter, unless written notice of intended change is served in accordance with Title 1, Section 6 of the Railway Labor Act, as amended by either party hereto at least sixty (60) days, but no more than two hundred and seventy (270) days, prior to January 7, 2010 or January 7th of any year thereafter, upon written notice to either party hereto. If such notice is served, negotiations will commence no more than 30 days after service. In the event a new tentative collective bargaining agreement has not been concluded by August 7, 2009 (or August 7th of any year thereafter, if applicable), the parties shall, no later than August 7, 2009 (or August 7th of any year thereafter if applicable), jointly invoke the services of the Board under Section 5 of the Act.

Effective as of the date of signing, all side letters remain unchanged.
