Pension Case in DC Court on Thursday, January 5, 2005

As we start a New Year, we have news in our legal track fight to preserve our retirement security. In our case against the PBGC that challenges the agency’s actions stemming from its backroom deal with United Airlines, the U.S. District Court in DC has scheduled a hearing for oral arguments on Thursday, January 5th at 3:00 pm. The court hearing is open to the public and we encourage Members to attend.

The United States District Court in Washington DC is located at Third Street and Constitution Avenue, Northwest -- one block west of the United States Capitol. Oral arguments will be made to Judge Huvelle in Judge Kessler's Court Room located on the 4th Floor of the Courthouse Annex.

The United States District Court for the District of Columbia Third Street and Constitution Avenue, Northwest, Washington, D.C.

Directions: The Courthouse is located one block west of the United States Capitol. The building faces Constitution Avenue where Constitution and Pennsylvania Avenues have merged. There is a convenient METRO subway station, Judiciary Square (Red Line), which is located at the east side of 4th Street between D & E Streets.

Legal Track Review

We are pursuing court action regarding the backroom deal between United and the PBGC to terminate all employee pension plans for $1.5 billion.

Court Action Against the PBGC in Washington DC:

  • AFA maintains the PBGC violated federal pension law in the actions that led to its take-over of our plan.
  • AFA attorneys prevailed in a hearing on August 10th to obtain certain internal documents from the PBGC that were relied upon directly or indirectly in reaching the $1.5 billion deal with United.
  • All briefs were submitted to the court by November 18, 2005.
