Following Judge Wedoff's approval of the PBGC sellout agreement, an emergency effort to halt the termination of potentially viable pension plans was launched by Congressman George Miller (D-CA). Congressman Miller introduced HR 2327 that would impose a six month moratorium on pension plan terminations instituted by the PBGC; and would apply to cases where the plan sponsor is in bankruptcy proceedings and the termination of the plan would result in a loss of benefits which are guaranteed.
This is an All Call to every AFA Member, retiree and other United employee to contact your Representatives right away. Check the cosponsor lists for HR 2327 and urge those who have not yet added their name to cosponsor the legislation as soon as possible.
United continues to lobby against our efforts on Capitol Hill. The only way we can combat their hired guns is to have Members, lots of Members continue to call your representative's offices.
Congress needs to know the score - United's high priced lawyers used a cheap procedural maneuver to pre-empt our rightful day in court to defend our plan under the standards of pension law - a day that would have ensured the viability of the Flight Attendant Pension Plan. Without this legislation, our pensions could be gone and the laws that protect them will be rendered meaningless.
Management may have found a way of superseding employee protections under pension law, but we are the voters and Congress must listen to us. They will listen to us as 28,000 active and retired AFA Members whose retirement security is on the line and they will listen to us as part of the 120,000 United Airlines employees who thought a pension promise was a sacred trust for a lifetime of service. They will listen to us as termination of our pensions will likely end retirement security for millions of Americans, placing the fallout on the PBGC's overburdened balance sheet and ultimately in the laps of all American taxpayers.
